A variance to Section 10.03, Subdivision 9 (C) to allow <br />construction of additions to the existing sports center <br />recreational accessory building, such additions increasing <br />the footprint of that structure to 14,090 s.f., with actual <br />floor area of 15,836 s.f. <br />B. A variance to Section 10.03, Subdivision 9 (C) to allow <br />the total of all accessory structure footprints on the <br />property to exceed the 6,000 s.f. normal allowance. <br />C, A variance to Section 10.03, Subdivision 9 (D) to allow <br />the proposed additions to the accessory structure to be <br />located closer to the road than the principal residence <br />structure. <br />Approval is subject to the following conditions: <br />X, This approval is for construction of the additions shown <br />on the attached site plan. Exhibit B. Any changes in plans <br />which result in relocation of the additions or which result <br />in the footprint or floor area above those currently being <br />approved, shall require further City Council review. <br />2. The declaration of covenants executed between Cralgbank <br />Associates and the City of Orono on July 13, 1987, shall <br />resMiln in effect. <br />3, Authorities granted by this resolution run with the <br />property not with the applicants, but are permissive only <br />and must be exercised by application for a building permit <br />within one year of the date of Council approval, or this <br />variance will expire on that date (Hay 13, 1992). <br />4. Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of <br />the soning code, shall automatically tersilnate any authority <br />granted herein, and shall be punishable as a misdemeanor. <br />5, The undersigned applicants have read, understood and <br />hereby agree to the terms of this resolution and on >^ehalf <br />of themselves, their successors and assigns, hereby agrees <br />to the recording of this resolution in the chain of title of <br />the property. <br />Page 8 of 10
