f''. <br />■A.* <br />1 Cf-'-->« <br />,4> <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />5, The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Conmiesion# reports by City staff* comments by the <br />applicants and the effect of the aftt.r-the-fact variance on <br />the health*safety and welfare of the community. <br />COMCLOSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above* the <br />Orono City Council hereby grants a variance to Municipal Zoning <br />Section 10.23* Subdivision 6 (B) to permit the construction <br />of an 18'x22* addition to the north or rear side of the existing <br />residence and per Section 10.22* Subdivision 1 (B) grants a <br />variance to the average lakeshore setback as portions of addition <br />vill be located in front of the average lakeshore setback line. <br />Approval is subject to the following conditions: <br />1. Applicants are placed on notice that if loft area is <br />converted to a legal bedroom* the septic system shall be re­ <br />evaluated at the time of such improvement. <br />2* Authorities granted by this resolution run with the <br />property not with the applicants* but are permissive only <br />and must be exercised by application for a building permit <br />within one year of the date of Council approval* or this <br />variance will expire on that date (April 22* 1992}. <br />3. Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of <br />the soning code* shall autosiatically terminate any authority <br />granted herein* and shall be punishable as a misdemeanor. <br />4. The undersigned applicants have read* understood and <br />hereby agree to the terms of this resolution and on behalf <br />of themselves* their heirs* successors and assigns* hereby <br />agree to the recording of this resolution in the chain of <br />tiltie of the property. <br />Page 3 of 5 <br />j* <br />IJ
