Reserved for Recording <br />DRAINFIELD COVENANT <br />THIS DRAINFIELD COVENANT is made effective as of ,, 1998, by Susan K. <br />VanMoorlehem and Douglas F. VanMoorlehem, wife and husband, their heirs, successors and assigns <br />(collectively, the "VanMoorlehems"), the owner of Lot 1, Block 1, Tumham Toll Addition, and Kenneth <br />Tumham and Edith L. Tumham, husband and wife, their heirs, successors and assigns (collectively, <br />"Tumhams"; VanMoorlehems and Tumham are collectively, the "Owners" and individually an "Owner"), the <br />owTier of Lot 1, Block 2 and Lot 1, Block 3, Tumham Toll Addition, for the purposes of protecting the sewage <br />drainfields and treatment facilities (collectively, the "Drainfields") that have been approved by the City of <br />Orono (the "City") and located on the foregoing described lots (individually, a "Lot" and collectively, the <br />"Lots") as depicted on Exhibit A hereto, as follows: <br />1. No constmction of driveways and buildings or earth moving equipment are permitted on a Lot <br />until the Owner of such Lot, or his/her agents or contractors, first: <br />A. Erects a clearly visible fence tw’enty feet from and along the boimdary of the Drainfields on such <br />Lot that are accessible to earth moving equipment or construction activities; and <br />B. Erects a clearly visible fence along the boundary of such Lot and the Drainfields on any adjacent <br />property that are accessible to earth moving equipment or construction activities. <br />2.
