CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. /I 0 Q 4 <br />3. <br />4. <br />5. <br />6. <br />The proposed plat consists of three residential lots each meeting the minimum <br />lot standard requirements of the RR-IA, Single Family Rural Residential Zoning <br />District, except as follows: <br />A.Lot 1 contains approximately 4.8 acres of dry buildable land and 17.5 <br />acres of wetland. No additional adjacent land is available for purchase, <br />and the only additional land available to the subdividers is within <br />the property but separated from Lot 1 by County Road 6. <br />B.Lot 1 does not meet the defined minimum 300’ lot width requirement as <br />measured at the rear line of the defined front yard. Lot 1 has a defined <br />lot width of approximately 280'. No additional adjacent land is available <br />to increase the lot width to a conforming status. <br />The granting of lot area and width variances for Lot 1 is justified by the fact <br />that Lot 1 contains an existing residence and accessory building meeting <br />all required lot line setbacks without the need for further variances, that Lot 1 <br />contains the necessary primar>' and alternate drainfield sites to support septic <br />system needs, and the fact that the only additional lands available for inclusion <br />with Lot 1 are across County Road 6. The Council notes further that the <br />granting of a lot area variance for a new subdivision in Orono is highly unusual <br />and in this case only justified by the unique geographic relationship between the <br />existing underlying tax parcel and the County and City roadways which have <br />been developed within it over many years. <br />Lot 3 is a 'through' lot subject to conditional use permit for placement of any <br />accessory structures. <br />All lots have been found to have adequate and suitable soils for on-site septic <br />treatment facilities providing both a primary and alternate site for each of the <br />three lots. <br />Lot 1 has a nonconforming septic system which under current City code must <br />be replaced by December 31, 2007. <br />i <br />Page 2 of 7
