A. <br />5. <br />6. <br />B. <br />D. <br />The boat house would only remain on the lot without a principal building <br />during the demolition and reconstruction period. <br />The lot is only required to meet 80% of lot area and width requirements <br />because it is sewered and less than 1 acre in size. <br />C. The size of the lot allows an adequate building envelope, no other <br />variances should be allowed to construct a new home. <br />A letter supporting the preservation of the boathouse was submitted by <br />a neighboring property owner located at 2691 Casco Point Road. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, tne Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.03, Subd. 9 (A); to permit an accessory <br />structure to remain on the lot without t principal structure for period between the removed of <br />the existing house and construction oi a new residence. Approval was subject to the following <br />conditions: <br />1. No other variances shall be approved by the City Council on this lot. <br />Page 2 of 4
