Walvatne <br />April 24, 1990 <br />Page 3 <br />To further compromise the matter, we offer to plant trees along <br />the south side of the road on Cliff's property as screening now. <br />We also offer to give you a promise to plant additional <br />screening where you wish it to be on your property at any time <br />over the next three years in the quantity specified in the <br />present landscape plan. That gives you the option of deciding <br />when you want the trees planted and where you want the trees <br />planted. Further, if you would like us to plant some of the <br />trees on Outlot c with the idea of transplanting them elsewhere <br />within the three year period if the road is built, we would do <br />that as well. <br />The foregoing are all of our thoughts to the present time. As <br />you know, time is extremely critical with regard to whether this <br />project is a go or a no go. You've indicated several times that <br />it is not your desire to stop the project, but rather to make <br />certain that you are being treated fairly and you are getting all <br />you are entitled to under the Orono planning process. <br />Please be aware that if you and the Gates do not sign the plat <br />you will have killed the project and the consequences will be <br />what they may. By contrast, in order that the project go forward <br />you and we must come to some compromise of the situation. To <br />that end it is essential that we meet as soon as possible due to <br />our time constraints with our contractors. The situation is that <br />they have held open their contracts for just so long and we will <br />not be able to hold them to their contracts too much longer. If <br />the contracts go away then the project will be dead for 1990 as <br />far as we can tell and at a minimum there will be great <br />unhappiness on our side. <br />Please talk this over and call in order to make arrangements to <br />meet us when and where you like, whether it be at your place, on <br />the site, at the city hall or at the city attorney's office in <br />Minneapolis.
