Block <br />I, Navarre Cove. 2503-2505 Kelly Avei-ue <br />As you are aware, the owners of the property located in the <br />adjacent Kelly Cove subdivision recently applied to the City for a permit <br />tor the installation of a dock system on the shoreline abutting their <br />property. This w ould allow the removal of the current system that is in <br />place pursuant to v arious prior approv als for this property The end result <br />would bt the elimination of the Outlot A common property and sole use of <br />the shoreline abutting Lot 3, Block I by that owner. <br />The proposal was discussed by the Council with objection from the <br />Mayer concerning the amount of boats that could be docked at the Lot 3 <br />property without any restrictions Correctly, the Mayor observed that up <br />to four watercraft could be docked at that property if used as a single <br />family residence and all watercraft were registered to the owner. The <br />Mayor insisted on a restriction of tw o watercraft on Lot 3. <br />We have reviewed the documents that create the histoiy of this <br />property and the current common propcrty/dock system It is clear from <br />the documents that the primary concern and reason for the system was the <br />protection of wetlands located close to tire Kelly Cove property. <br />The wetlands issue is no longer relevant, as the application by <br />Kelly Cove had no impact on any wetlands, and the wetland that existed <br />when the original Kelly Cove plat was filed are no longer present <br />Therefoie. the reason for the common dock scheme is no longer present. <br />The wetland is no longer an issue The documents creating the <br />current common dock scheme weie never recorded against Lot 3 Despite <br />this, Mr, Hoyt is willing to agree to restncl the use of l otto two slips <br />1 his compromise .should alleviate any concerns that have been raised by <br />the Mavor. and allo.\ for a resolution to this issue <br />253 East Lake Street, V<‘avzata, Minnesota 55391 <br />..;‘'
