Mr. Kluth originally applied for a Guest House Conditional Use Permit to allow one toilet <br />and one sink in an accessory structure on the property. <br />City Staff has presented a proposed Zoning Code Amendment that would allow the applicant to <br />apply for a Plumbing in Accessorj' Building Conditional Use Permit". The intent of the CUP would <br />allow accessory buildings not intended to le used as dwelling units to have an approval process that <br />would allow plumbing to exist. <br />The following criteria must be met to grant approval for a "Plum! in Accessory Structure <br />V irtV.'ltlonal II«f» Pprmit" <br />1. <br />2. <br />The Council finds the proposed use of the accessory structure with plumbing will not be <br />detrimental to the residential character of the neighborhood. <br />The Council finds that the plumbing fixtures proposed are in keeping with the intended use <br />of the accessory building. <br />The property is 2.0 acres in area or larger. <br />The accessory building is conforming in location, size and height. <br />T^e property owner agrees to the filing of a covenant in the title of the property providing <br />a. the accessory building will not be used for a home occupation unless specifically <br />approved by the City or if allowed by City Code.
