COUNCIL M££Tirv3 <br />OCT 2 6 1998 <br />REQUEST FOR COUNCIL ACTION <br />CrrYOFGRONO <br />DATE; 10/22/98 <br />ITEM NO <br />Department Approval: <br />Name Paul Weinberger <br />Title Assistant Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description: Paul and Megan Bennett <br />500 Hanlon Avenue <br />Sewer Assessment on Tax Forfeit Parcel <br />________________Lot 24, Block 14, Minnetonka Bluffs, Hennepin County, Minnesota_____ <br />Background <br />In 1980, the Minnetonka Bluffs sewer project area was assessed such that, if a homeowner owned <br />two or more contiguous parcels, the assessment was spread across the parcels rather than assessed <br />only to the parcel containing the house. This has resulted in a situation in which a property owner <br />who owned two contiguous parcels on Hanlon Avenue (please see attached map) paid the portion <br />of the assessment on the parcel with the house and allowed the other parcel to go tax forfeit. The <br />parcel with the house has been sold twice since the lot was allowed to go tax forfeit. <br />In 1987, the City Council adopted Resolution Number 2126. The resolution stated that the parcel, <br />currently tax forfeit, (P.I.D. 02-117-23 31 0026) be released subject to the condition that all <br />outstanding special assessments shall be paid in full to the City upon return to private ownership. <br />Any amount not recovered at the time of sale shall be subject to reassessment by the City. <br />In 1996. the property owners, previous to the current owners, requested the Ci>y Council waive all <br />past interest and penalties and allow reassessment of the property for $3,350, the amount of the <br />sewer assessment never recovered by the City. <br />The City Council, on October 28,1996, approved the collection of only the principal amount of the <br />sewer assessment for Lot 24 adjacent to 500 Hanlon Avenue, to be paid in five equal installments <br />of principal, plus interest at an annual rate of 7%, with the condition that the tax forfeit parcel be <br />legally combined with the 500 Hanlon Avenue parcel. <br />The applicants have requested to purchase this lot to increase the size of their property to allow for <br />the building of a garage (Zoning Application Number 2413, which does require several setback <br />variances). The previous owners requested the lot to allow for the property right to build a garage. <br />Lot 24 is unbuildable due to its size and most of the lot is a pond/wetland.
