City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1916_ _ _ _ _ _ <br />5. Dedication to the City of a Flowage and Conservation <br />Easement providing for limitations on the use of a drainage- <br />way described therein and shown on the plat as "drainage <br />easements". Drainage through the underground tile may never <br />be restricted or altered without proper application and <br />approval by the City of Orono. <br />6. Payment to the City of a Park Dedication Fee in the <br />amount of $400.00. <br />7. Payment to the City for the legal review and filing of <br />the plat easements and covenants in the amount of $150.00; <br />and <br />8. V7hereas, the subdivider has completed all requirements <br />of the platting regulations of the City of Medina and was <br />granted final subdivision approval by its Council on <br />February 4, 1986. <br />NOW, THEREFORE BE IT RESOLVED, that the City Council of <br />the City of Orono hereby approves the plat of Phillips Woodland <br />Terrace, Hennepin County, Minnesota; subject to the following <br />conditions: <br />1. Lots 1 and 2 shall achieve access via a shared private <br />driveway or private road over Outlot B. <br />2. A conditional use permit will be required by the City of <br />Orono prior to the construction of the private road within <br />Outlot B. <br />3. The septic test areas on Lot 1 shall be protected by <br />installing berms along the west side of both the primary and <br />alternant septic sites or to the east side of Outlot B, or <br />if road is constructed first, developer must provide <br />protection for septic area during construction and design <br />road so that drainage is directed away from protected area. <br />4. First habitable floor level of future residence on Lot 1 <br />must be no lower than the 1007.5 elevation. All changes in <br />elevations or grades on Lot 1 outside of those approved in <br />the original building permit review must be approved by the <br />City of Orono. <br />5. Future owners of Lots 1, 2 and 3 are placed on notice <br />that it is their responsiblity to mai’^tain and repair the <br />underground drainage tile line that intersects their <br />properties. <br />Page 2 of 3
