Criteria for Determining Undue Hardship <br />1. <br />2. <br />4. <br />5. <br />6. <br />The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the ofTicial controls. <br />The residence located on the lot was constructed prior to the current zoning regulations <br />resulting in the house being located into the front yard setback. The applicants have stated <br />the existing stairs and porch are in need of replacement. <br />Tlie lot topography requires steps to access the front door. The porch and roof structure <br />would be minitnal in size and would not encroach closer to the front lot line than the house <br />which it would serve. <br />The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The property was platted and developed prior to the zoning standards. The house is located <br />the same distance from the front lot line us the proposed addition. <br />The house is located atop a steep hill requiring steps and a porch to access the front door. <br />Adding a roof to the steps has become necessary due to the weather conditions. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The variance would not change the locality, as the property would be used as a single family <br />residential lot. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />The use of the property would remain residential, which is consistent with the zoning. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />i^242} Cara Cehnng and Tom Terry <br />240 Leaf Street <br />Tariance <br />! 0/19/93 <br />Page}
