r <br />STATEMENT OF HARDSHIP <br />Criteria for Determining Undu? Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property can continue to be used as a residence without the variances. However, ^ <br />existing residence has a 905 sq. ft. footprint. Additions were made in 1956 and 1964. The <br />applicants are asking for variances to increase the amount of space in their home a*id improve <br />the flow of the floor plan, maximize lake views, add living sr ace and upgrade bathrooms. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The situation is caused by the existing residence being located forward of the average <br />lakeshore setback and in the top of the bluff setback area. A hardcover variance coidd <br />be eliminated if the sidewalk and driveway turnaround were removed, however, staff <br />is not recommending that this non-structural hardcover be removed. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />If the variances are granted, the second story addition will not interfere with views from <br />adjacent property nor have an impact on the ravine. <br />4.The special conditions applying to the structure or land in question are peculiar <br />to such property or immediately adjoining property. <br />The existing residence was constructed before the current zoning regulations. <br />5.The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />The subject lot is unique due to its location near the ravine, the topography of the lot <br />and the need to retain the sidewalk and driveway turnaround, and the proximity of <br />the adjacent residences and the average lakeshore setback. <br />6.The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />$2368 KtrkOneson <br />110 Sorth Arm Drive <br />July 20. 1998 <br />pagt—4 <br />J
