Ryan Jr. <br />Variances--Public Hearing <br />Zoning District:RR-IB One Family Rural Residential District (2 Acre) <br />Lot Area:70,881 square feet (1.62 acres) <br />Application: The applicant has proposed to construct a 90' wind tower as an additional <br />source for electricity to serve his property. Mr. Ryan in his hardship statement has indicated the <br />need for the structure results from periodic NSP power outages and to provide a backup source for <br />electricity should there be a disruption in service related to the year 2000. <br />This application requires the following variances: <br />1 . Structure height to exceed 30'. The applicant has requested a 90' wind tower, exceeding the <br />allowed height by 60 feet. <br />The Zoning Code does not allow wind towers. Should the Council approve a height variance a <br />Zoning Code Amendment would also be required as the existing Zoning Code would not allow this <br />type of use. <br />PLANNING COMMISSION RECOMMENDATION: <br />The Planning Commission recommended by a 6 to 0 vote to: <br />Deny the variance for the reasons listed below: <br />1 . The use is not consistent with a residential area. <br />2. The variance would require a Zoning Code Amendment as the use is not permitted. <br />3. The hardship is not unique to the property as power outages impact large areas, and they are <br />a responsibility of NSP.
