A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.56, SUBDIVISION 16 (C) (6) <br />FILE #2419 <br />WHEREAS, William Hoeft and Anastasia Hoeft (hereinafter "the applicants ) <br />are owners of the property located at 1725 Bohns Point Road within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lots 4 and 5, Block 1. Auditor's Subdivision No. 349, Hennepin County. Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance wth <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Pjanning <br />Commission held a pubUc hearing on September 28. 1998, at which times ^ persons desinng <br />to be heard concerning this application were given the opportumty to speak thereon, and <br />WHEREAS, the applicants have applied to the City for variances to Mumcipal <br />Zoning Code Section 10.56. Subdivision 16 (C) (6) to permit the construction <br />encroaching 35' into the average lakeshore setback wd a pool terrace encroaching 40 <br />average lakeshore setback where no encroachment is normally allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2419. <br />The property is located in the LR-IB, One Family Lakeshore Residential Zoning <br />District, where 1 acre or 43,560 sq.ft, is the minimum lot area. The property <br />consists of 2.92 acres or 127,382 sq.ft. <br />Page 1 of 4
