r <br />4. <br />5. <br />6. <br />The Orono Planning Commission reviewed this application on September 21, <br />1998, and recommended approval on a vote of 6 to 0 of the proposed after-the- <br />fact variances and conditional use permit, based on the following findings: <br />a. <br />b. <br />c. <br />d. <br />The property contains a steep hill that is dangerous to maintain. The <br />landscaping has eliminated the need to mow grass and allows soil to <br />absorb water. <br />The hardcover on the lot has been reduced in the 75-250’ setback area <br />from 42.5% to 39.8%. <br />Tne hardcover in the 250-500’ setback area has been reduced from 31.8% <br />to 29.7%. <br />The applicants shall be required to pay double permit fees as required on <br />after-the-fact applications. <br />The Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district; that granting <br />the variances would not adversely affect traffic conditions, light, air nor pose a <br />fire hazard or other danger to neighboring properties, would not merely serve as <br />a convenience to the applicants, but is necessary to alleviate a demonstrable <br />hardship or difficulty; is necessary to preserve a substantial property right of the <br />applicants; and would be in keeping with the spirit and intent of the Zoning Code <br />and Comprehensive Plan of the City. <br />The City Council finds that granting an after-the-fact conditional use permit to <br />allow land alteration within 75’ of the lake shore will not be detrimental to the <br />health, safety or general welfare of the public, would not adversely affect light, <br />air nor pose a fire hazard or other 'danger to neighboring property, nor will its <br />use depreciate surrounding property values and that the proposed level of use of <br />the property will be in keeping with the intent and objectives of the Zoning Code <br />and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Page 2 of 4
