No other location exists on the lot where a garage can be located. <br />C.The garage replacement does not increase the amount of hardcover <br />beyond the amount that previously existed nor further encroach into the <br />side yard setback than the former garage. <br />D.The zoning lot does not conform to minimum zoning requirements for <br />the LR-IB district. <br />4.The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keepi', with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of ‘ - <br />5.The City Council has considered this application including ' midings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above fmdings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.24, Subdivision 5 (B) and Section 10.22, <br />Subdivision 2 to allow 31.75% hardcover in the 250-500 ’ setback where 30% is allowed and <br />to allow a side yard setback of 6.16' where 10' is required to permit construction of a new <br />24'x26' garage in the same location as the previous garage that was destroyed by fire. <br />Approval was subject to the following conditions: <br />1. The existing shed encroaches in the required r;.ir yard setbacks. If the shed is <br />destroyed, it shall not be allowed to encroach in the required yard or increase <br />in size. <br />Page 2 of 4
