The barn's roof needs to be replaced if it is going to be kept for use. If it will be <br />used as a bam, a 75' setback is required from the new lot line. The ability to obtain a conditional use <br />permit in the future to keep a horse is not dependent on having a bam. <br />If the bam vkdll be used for storage as an accessory structure, th'i: new lot line needs to be 50' from <br />the rear wall of the structure. <br />It is important to know that the Planning Commission and City Council don't generally approve <br />variances for setbacks when lot lines are being rearranged. <br />The factors to consider are: <br />1 . The structure is existing but needs a new roof to be sound. <br />2. The structure is legally non-conforming as to the required setback from the north <br />property line. . <br />3. Keeping a horse requires a conditional use permit, 3 acres minimum lot size with 2 <br />acres for pasture, not to include the septic sites. <br />4. Staff would defer to a horse expert on whether the site was appropriate for a horse. <br />5. A bam is not required by ordinance to keep a horse. <br />I cannot anticipate whether the City Planning Commission and City Council would favorably <br />approve a conditional use permit for a horse in the future. As Orono has gro>^, the keeping of <br />horses and complaints that I have received for adjacent neighbors of other properties have noticeably <br />increased. That is one of the reasons why staff relies on a horse expert to objectively review the <br />property without influence from neighbors. <br />I would appreciate knowing what your decision is on the bam before September 1 1th so that I can <br />process the staff report in a timely manner.
