A variance would be required to <br />build a new or larger garage. <br />ANALYSIS <br />Conditional Use Permit > For the replacing of retaining walls. The applicant has stated no <br />grading work or filling has been done on the property. <br />2. <br />3. <br />That the proposed location of the conditional use is in accord with the objectives of the <br />Zoning Chapter and the purposes of the district in which the site is located and <br />Comprehensive Municipal Plan. <br />The applicants have built retaining walls within 75' of the lake. If the Conditional Use <br />Permit is approved a variance from tlie Zoning Code is necessary. <br />That the proposed location of the conditional use and the proposed condition under <br />which it would be operated or maintained would not be detrimental to the public health, <br />safety, or welfare, or materially injurious to properties or improvements in the vicinity. <br />The location of the conditional use would not be detrimental to public health. They have <br />replaced the retaining walls to prevent further erosion on the property.
