Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />i ■ <br />FINDINGS <br />1. This application was reviewed as Zoning File #2390. <br />2. The property is located in the LR-IB, Zoning District, where 1 acre is the <br />minimum lot area. The property consists of ,33 acres or 14,663 sq. ft. <br />3. The Planning Commission reviewed this application on August 17, 1998 and <br />recommended approval on a vote of 4 to 2. <br />4. The Planning Commission made the following findings of fact: <br />A, The subject lot does not meet lot width or lot area requirements. <br />B, This property is allowed to have 1,978.25 sq. ft. (25%) of the total lot <br />area in the 75-250' setback in hardcover. The City Council determined <br />per Resolution No. 3926 that the total amount of hardcover to be located <br />within the 75-250' setback shall be reduced by the amount of existing <br />hardcover (1,320.75 sq. ft.) in the 0-75' setback. <br />C.A portion of the yard between the house and the street is located in a <br />flood plain area. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5
