A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBD. 9 (D) AND <br />SECTION 10.22, SUBD 2 AND <br />SECTION 10.56, SUBD 16 (L)(2) <br />FILE NO. #2407 <br />WHEREAS, Lane and Kelly Moore (hereinafter "the applicants") are the owners <br />of the property located at 3438 Livingston Avenue within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />Lot 19, Block 2, "Navarre Heights, Hennepin County, MN" (hereinafter "the <br />property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statues and the City of Orono Zoning and Planning Codes, the Orono Planning Commission <br />held a public hearing on August 17, 1998, at which times all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.03, Subd. 9 (D); Section 10.22, Subd. 2; and Section 10.56, Subd. 16 <br />(L) (2) to permit the construction of a garage 3’ from the side lot line where 10’ is required <br />and to allow 36.0% hardcover in the 500-1000’ lakeshore setback. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #2407. <br />2. <br />3. <br />The property is located in the LR-IC Single Family Lakeshore Residential <br />Zoning District where 1/2 acre or 21,780 sq. ft. is the minimum lot area. The <br />property consists of .15 acres or 6,625 sq. ft. <br />The Orono Planning Commission reviewed this application on August 17, 1998 <br />and recommended approval by a vote of 6 to 0. <br />Page 1 of 4
