A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.28 SUBD. 5 (B) <br />FILE NO. #2354 <br />WHEREAS, Konrad Krueger (hereinafter "the applicants") are the owners of the <br />property located at 520 Hanlon Avenue within the City of Orono (hereinafter "the City") and <br />legally described as follows: <br />Lots 17 and 18, Block 15, "Minnetonka Bluffs, Hennepin County, MN" <br />(hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.28, Subd. 5 (B) to rehabilitate the existing residence by adding a <br />second story and a tuck under garage. Variances for front, side and rear yard setback are <br />required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2354. <br />The property is located in the RR-IB Single Family Rural Residential Zoning <br />District requiring 2 acres in area. <br />3.The Orono Planning Commission reviewed this application on April 20, 1998 <br />and recommended approval of the proposed variances based upon the following <br />findings: <br />A. The zoning lot does not meet lot area or lot width minimum <br />requirements. <br />B. The existing residence encroaches into the required front, side, and rear <br />yard setbacks. <br />Page 1 of 4 <br />1
