5. <br />A. The subject property does not meet lot area or lot width standards. The <br />existing residence does not meet the side yard setback from the east <br />property line. <br />B. The lot provides driveway access to the adjacent lakeside property which <br />is also owned by the applicants. <br />C. The property currently does not have a garage. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 and 2 and Section <br />10.56, Subdivision 16 (C-1&2) to permit construction of a 14'x20' garage where hardcover <br />exceeds the maximum allowed. A variance is required to increase from 39.4% to 40.1% in <br />the 250-500' setback where 30% is allowed. Approval was subject to the following conditions: <br />6. <br />I.The garage shall not exceed 14’x20' and shall be located 10 ft. from the rear and <br />side property lines. <br />2. The existing shed in the street yard shall be removed. <br />3.The applicants and future owners are on notice that future requests to increase <br />hardcover will not be favorably reviewed. <br />Page 2 of 4
