They should also be asked <br />for their testimony regarding this issue. <br />rriteria for Determining T Indue Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official control!is. <br />The existing residence and deck were built prior to cunent zoning regulations. Any proposed <br />improvements to the residence may require variances from lakeshore and average lakeshore <br />setback regulations. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The lot was platted prior to current zoning requirements. The house and deck were also <br />constructed before the current zoning requirements. This condition has resulted in the lot <br />encroaching into the 75 foot and lakeshore average setback distances. <br />3. The variance, if granted, may alter the essential character of the locality. <br />The structure currently exists on the lot within the average lakeshore setback distaiice.^ I^e <br />variance for encroachment into the setback applies to the 2nd story addition over the existing <br />structure. A variance from this requirement would not alter the residential character of the <br />neighborhood, or would it alter the use of the property. <br />4.The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />Single family residential use is permitted in the LR-IB (One Family Lakeshore Residential) <br />zoning district. <br />»2330 Bnict It*.
