However, that section <br />does non-riparian land owners within a subdivision adjacent <br />to 4 lake which initiates a new joint use shall adhere to LMCD regulations imd no such^ <br />shall have more than one boat slip per 50' of shoreline as me^ured by '"j= <br />the points at which the side lot lines meet the OHWL. Further, all such use shall adhere to <br />the Shoreland Management Regulations of Section 10.56." <br />The proposed use appears to meet the one slip per 50' of shoreline standard, since ^ nte^“«<* °n <br />a sMiota line Lots 1 and 2 contain 220’ of width, which would allow up to four boats. Further, the <br />nro^ofed uTe appearTto meet the standard which disallows any use which creates the need for <br />addUional parking on any street right-of-way or additional parking stalls. Since die proposed four <br />slips will be used by four adjacent land owners with pre-existing parking areas, <br />no impact on streets or right-of-ways. Further, there appears to be no need for additional hard <br />surface areiis. <br />The proposed docks would appear to be located in one of the widest portions of the lagoon, hence <br />no boat traffic problems are anticipated. <br />Staff Recommendation <br />Staff recommends approval of the application of the K.lly Cove <br />conversion of a six unit joint use dock to a four unit joint use dock, subject to dock des^n <br />location as proposed, and subject to ultimate legal combination of Outlot A ^d Lot ^ <br />Cove by the ovsTier of Lot 3; and that the easements over Lot 3 and Navarre Co% e Outlot A <br />of Lots 1 and 2 Kelly Cove be extinguished. <br />Public Hearing Option <br />Tlie joint use dock license standards allow Council to call a public hearing at Council's discretion <br />TOs application was received on June 12, and is brought f.mvard f” <br />a resolution pending Council action. One of Council's options would be to call for a pubhc hearing <br />if there is some peredved negative impact to the City or to other users of the lagoon. Such a hearing <br />could be published for the July 13th Council meeting.
