A permit was recently issued for removal of the pool, and the applicant proposes <br />removal of the remaining structure to replace it with a new residence. The new <br />construction will be located 119' from the lake, slightly further from the lake than the <br />existing residence, in order to conform to the average lakeshore setback. <br />5. The only hardcover in the 0-75' zone is a 74 s.f. stairway to the lake, which is allowed <br />by code. Hardcover in the 75-250' zone is proposed to decrease from 39.4% to 34.5%. <br />Approximately 4,815 s.f. or 20.8% is structural hardcover, the remaining 13.7% is <br />sidewalks, patio and driveway area. <br />Grading and Drainage <br />Applicant has provided a grading and drainage plan for the property which proposes swales <br />within the property boundaries on either side of the house to provide adequate site drainage and <br />eliminate impact on neighboring properties. This plan potentially improves the impact of <br />drainage to the two neighboring properties. <br />Applicant's Hardship Statement <br />"The lot is very long and narrow. To build a house on it and keep the resale value in keeping <br />with the other new houses in the neighborhood, it is very difficult to meet the 25% hardcover <br />rule. There will be a reduction in existing hardcover." <br />Criteria for Determining Undue Hardship <br />1. <br />2. <br />The property in question cannot be put to reasonable use if used under conditions <br />allowed by the official controls. <br />• A residence could be placed on this property without the need for hardcover <br />variances. Applicant suggests that such a limitation would result in a residence <br />not in keeping with the neighborhood and therefore would not be reasonable. <br />The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />• The circumstances leading to the hard‘"i\er variance are not unique to the <br />property, since the same 'resale value' issues arise for most lots on our high- <br />value lakeshore.
