Structural Coverage <br />Structural coverage is not an issue with this application as the lot exceeds the 2 acre minimum lot <br />requirement. <br />Hardcover <br />Hardcover is not an issue with this application as the subject property is not located within 1000' <br />of a protected body of water. <br />STATEMENT OF HARDSHIP <br />The residence was constructed 55 feet from the front lot line, in 1900, well before the zoning <br />code required a 100 foot setback in the RR-IA zoning district. This condition has resulted in the <br />applicant’s inability to improve the structure by constructing a three season porch. The applicant <br />should also be asked for their testimony regarding this issue. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property can continue to be used in its current state. The addition will not alter the <br />use of the property. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The existing residence was constructed prior to the current requirements of the zoning <br />district. The residence encroaches into the 100 foot required front yard setback. All other <br />setbacks are met by existing structures on the property. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The surrounding properties consist of residential properties. The use of the applicants <br />property would not change if the proposed variance is approved. <br />4.Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />U2379 Deborah Shall <br />4100 WaterlowTt Road <br />Variance <br />June 15, 1998 <br />Page 2
