This
condition restricts the applicant from constructing a fence to enclose the back yard over the
minimum standard height of 3 1/2 feet.
Criteria for Determining Undue Hardship
1.The property in question cannot be put to a reasonable use if used under conditions
allowed by the official controls.
The property can be put to a reasonable use as it exists. Although, the applicant has
indicated a 4 foot fence will provide more protection for his children and family pet from
County Road 6. The Zoning Code requires a maximum height of 3 1/2 feet for that part
of the fence encroaching into the setback distance.
1 >
U2378 William Z Mernik
1840 Lakeview Terrace
Variance
6/15/98
Page2
--
