A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBD. 15 (C) AND (D) <br />FILE NO. #2378 <br />WHEREAS, William Z. and Lisa J. Memik, (hereinafter "the applicants") are <br />the owners of the property located at 1840 Lakeview Terrace within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Lot 5, Block 1, "Long Lake Country Club Addition, Hennepin County, MN" <br />(hereinafter "the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission <br />held a public hearing on June 15, 1998, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.03, Subd. 15 (C) and (D) to permit the construction of a fence in the <br />side and rear yards of a through lot to be 4 ft. in height where 3.5' is allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />1. <br />2. <br />3. <br />FINDINGS <br />This application was reviewed as Zoning File #2378. <br />The property is located in the LR-IA, One Family Lakeshore Residential Zoning <br />District where 2 acres is the minimum lot area. The property consists of .994 <br />acres or 43,328 sq. ft. <br />The Orono Planning Commission reviewed this application on June 15, 1998 and <br />recommended approval by a vote of (7 to 0). <br />4.
