5. <br />6. <br />E. <br />The Planning Commission made the following findings of fact: <br />A. The lot conforms to the minimum zoning requirements for the LR-IB <br />district. <br />B. The property is located on a peninsula. <br />C. The property contains unique topographical constraints. <br />D. Surface runoff from 25.2% of the total hardcover is treated in a drainfield <br />area. <br />The land alteration will balance the cut and fill in the floodplain. <br />The City Council finds that granting a conditional use permit to allow the <br />redistribution of 50 cubic yards on the property will not be detrimental to the <br />health, safety or general welfare of the public, would not adversely affect light, <br />air nor pose a fire hazard or other danger to neighboring properties, nor will its <br />use depreciate surrounding property values and that the proposed level of use of <br />me property will be in keeping with the intent and objectives of the Zoning <br />Code and Comprehensive Plan of me City. <br />The City Council has considered mis application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by me applicant and the effect of die proposed conditional use permit on me <br />heaim, safety and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a conditional use permit per Municipal Zoning Code Section 10.03, Subdivision 19-21 <br />and Section 10.55, Subdivision 4 (B) to permit alteration of a lakeside yard located on a <br />peninsula m the floodplain by scraping 1" from the lawn and redistributing above the 934.5' <br />elevation.
