r <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.21 SUBDIVISION 5 (B) <br />FILE NO. #2367 <br />WHEREAS, Lawrence E. and Rosemary C. Gleason(hereinafter "the applicants") <br />are the owners of the property located at 140 Hackberry Hill within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Lot 3, Block 1, "Daniels Long Lake Heights, Hennepin County, MN" (hereinafter <br />"the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public heariiig on May 18, 1998, at which times all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon; and <br />WTIEREAS, the applicants ha\e applied to the City for a variance to Municipal <br />Zoning Code Section 10.21, Subdivision 5 (B), to permit a side yard setback of 8’ where 14.0’ <br />is existing and 10' is required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />2. <br />3. <br />FINDINGS <br />1. This application was reviewed as Zoning File #2367. <br />The property is located in the R-IB, One Family Residential District where 1/2 <br />acre or 21,780 is the minimum lot area. The property consists of .53 acre or <br />23,100 sq.ft. <br />The Planning Commission reviewed this application on May 18, 1998 and <br />recommended approval on a vote of 5 to 0. <br />4.
