ORONO CITY COUNCIL MEETING <br />MINUTES FOR APRIL 27, 1998 <br />(^13) U2353 Lett Busch, 1265 Shoreline Drive - Continued <br />Jabbour expressed his concern that the hardships be stated in the resolution and that the driveway <br />be safe after any hardcover removals. <br />Kelley asked how the City could be sure the next owner would not install a paved driveway up to <br />the structure, which would add more hardcover, and make it a 2-car garage. <br />Goetten expressed her concern about the size of the structure, indicating it was very large. Busch <br />explained that woodworking requires a large area to work, up to 24' when planing a board. Several <br />pieces of equipment are used in making cabinets. <br />Peterson asked what the net effect of hardcover would be. Van Zomeren responded that it would <br />be 300 s.f. She suggested that if garage doors were not allowed, a building permit would be required <br />to install them at a later date. Kelley commented that garage doors would be needed to do the type <br />of woodworking Mr. Busch was proposing. <br />Van Zomeren added that the surveyo*' did not show any easements for the sewer. In talking with the <br />Public Services Director, these easements should be recorded. The applicant agreed to do so. <br />Flint ^ked if there were no other possible location on the property for the structure. Van Zomeren <br />explained that a well on the other side of the garage limits that area. <br />Goetten suggested that no more hardcover be allowed in the future if the motion passes. <br />Flint moved, Jabbour seconded, to amend the motion adopting Resolution No. 4073 to include the <br />condition that no additional hardcover is to be allowed. Vote: Ayes 3, Nays 0. Kelley and Peterson <br />voted against the motion. <br />(#14) JOHN DALBEC REQUEST FOR COUNCIL DETERMINATION REGARDING THE <br />KEEPING OF HORSES AT 30 ORONO ORCHARD ROAD NORTH <br />Moorse explained that Dalbec made a complaint about the keeping horses of 30 Orono Orchard Road <br />North and questioned the legality of it. Staff researched the issue and prepared a letter to Dalbec <br />listing the findings and concluding that two horses should be allowed to remain on the property. <br />Dalbec has asked that Council reconsider the conclusion. <br />Jabbour asked Dalbec to comment on his position. Dalbec distributed a letter to Council and the <br />owner of the residence. Dalbec stated the lot size is too small, the pasture doesn't meet the minimum <br />size, and the building doesn't meet the setbacks.
