A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.25, SUBDIVISION 6(B), <br />FILE NO. #2336 <br />WHEREAS, Bruce Newton (hereinafter "the applicant") is the owner of the <br />property located at 3580 Frederick Street within the City of Orono (hereinafter "the City") and <br />legally described as follows: <br />Lots 17 and 18, Block 2, Navarre (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for an after-the-fact variance <br />to Municipal Zoning Coae Section 10.25, Subdivision 6(B) to permit the retention of a deck <br />replacement on the north side of the residence that encroaches into the required rear yard <br />setback. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #2336. <br />2.The property is located in the LR-IC Single Family Rural Residential Zoning <br />District requiring .5 acre in area. The property consists of 14,000 s.f. or .32 <br />acre. <br />3.The Orono Planning Commission reviewed this application on February 17, 1998 <br />and recommended approval of the proposed variance based upon the following <br />findings: <br />1 . The deck was a replacement of a previously existing one of similar size. <br />2. The rear yard functionally serves as the side yard. <br />Page 1 of 4
