5. <br />6. <br />7. <br />8. <br />9. <br />3 Lots 4, 5 and 6 shall be exempt from meeting the 'average lakeshore setback <br />standards of the Orono Zoning Code. <br />4. Lots 4, 5 and 6 are subject to City Shoreland regulations regarding protection <br />of the bluff located on said Lots. <br />Setbacks for all principal residence construction shall be as depicted on the <br />preliminary plat drawing. <br />All Lots shall access to the private road in Outlot A. No direct access to Old <br />Crystal Bay Road shall be allowed for any Lot. All existing accesses to Old <br />Crystal Bay Road shall be removed prior to City final approval of the private <br />road construction. <br />The private road in Outlot A shall be constructed to City private road <br />requirements, subject to a Developers Agreement to be executed between the City <br />and the developer. Private road construction can begin as soon as the <br />engineering plans for the road have been approved by the City and the <br />Developers Agreement has been executed. <br />The private road shall be allowed to access directly to County Road 84 subject <br />to conditions for such access as imposed by the Hennepin County Department <br />of Public Works in their required access permit. <br />10. <br />11. <br />12. <br />Driveway to serve Lot 7 shall extend from the private road in Outlot A within <br />the portion of said Outlot extending along Old Crystal Bay Road. <br />The private road shall be privately owned and maintained per the approprwte <br />access easemcnt/maintcnance documents to be executed by the developer. e <br />developer shall create a homeowners association for such ownership an <br />maintenance. <br />No building permits will be issued until the private road base work has been <br />completed and been approved by the City. <br />The developer shall grant to the City an underlying Road and Utilities Easement <br />for Outlot A. <br />Page 5 of 10 <br />.
