Brook Park Realty, LLP (the Applicant) relating to the application for a planned <br />residential development (PRD) approval and preliminary plat subdivision approval for construction of a <br />30 unit townhome project (the Project) located west of Livingston Avenue and north of County Road 15 <br />in the City of Orono (the City). This application was filed with the City on September 26,1997, as <br />Application No. 2308 and processed for review through city staff, city planning consultants and the city <br />planning commission. <br />It is our opinion that by virtue the provisions of Minnesota Statutes § 15.99 the City has forfeited its right <br />to further review of this application and the application is deemed approved as an operation of state law. <br />Minnesota Statute § 15.99 provides in relevant part: <br />15.99 Time Deadline for Agency Action. <br />Subd. 2. Deadline for response. E.xcept as otherwise provided in this <br />section and notwithstanding any other law to the contrary, an agency must <br />approve or deny within 60 days a written request relating to zoning, septic <br />systems, or expansion of the metropolitan urban service area for a permit, <br />license, or other governmental approval of an action. Failure of an agency <br />to deny a request within 60 days is approval of the request. If an agency
