IITION NO <br />The applicant was present. <br />Bresslcr reported that the applicant is requesting an after-the-fact variances for hardcover <br />in the 0-75' lakeshore setback, lakeshore setback, and average lakeshore setback to allow <br />the retention of a rebuilt deck on the lake side of the residence The Planning <br />Commission recommended approval. Bressler reviewed the findings. <br />Jabbour was informed by the applicant that she gradually rebuilt the deck and apologized <br />for the misunderstanding. Zauner said she did reduce the size of the deck by removal of <br />posts and eliminating planters. Zauner said her hardship was her being transferred to <br />another state and the house is under contract. <br />Jabbour noted that the property is substandard and there is no additional land to <br />purchase. The residence was built prior to zoning and to utilize the residence, a variance <br />is necessary. Nothing would exist on the lot without a variance. <br />Goetten asked that the resolution include the condition that no more hardcover would be <br />allowed on the property in the future. <br />Flint moved, Goetten seconded, to approve Resolution No 4057 with the added <br />condition that no more hardcover be allowed on the property. Vote; Ayes 4, Nays 0. <br />Jabbour asked Van Zomeren to include in resolutions boilerplate language stipulating that <br />no additional hardcover w'ould be allowed on these smaller lots. <br />(#19) PARK DEDICATION AMENDMENT - ZONING/SUBDIVISION <br />ORDINANCE <br />Gaffron reported that the amendment to the ordinance addresses the issue of rough <br />proportionality, providing a basis for determining the amount of park tees in relation to <br />the impact of both residential and commercial subdivisions on the City's parks. The <br />ordinance establishes that there will be maximum and minimum "per dwelling " park fees <br />established each year Language has been added regarding how park funds can be used. <br />Other language has been eliminated regarding minimum contributions per lot. The <br />ordinance does not e.stablish park dedication requirements tor the development of <br />properties absent a subdivision/PRD/PUD process. Additional discussion is required on <br />this topic <br />Goetten asked where there is a problem with that issue.
