Vote; Ayes 4, Nays 0. <br />(#10) #2327 ORONO DEVELOPMENT, LLC - B-5 DISTRICT - AMENDMENT - <br />ORDINANCE ADOPTION NO. 170, 2ND SERIES <br />John O'Sullivan and Tom Dillon were present. <br />Gaffron reported that the request is to amend the B-5 zoning district to allow coffee and <br />bagel shops as conditional uses. The application was tabled at the request of the Council <br />to allow for additional information to be gathered. Gaffron reviewed the number of <br />issues that had been identified reuarding specific uses, such as limiting the tvpe of foods <br />allowed or accepting the use at face value. Other issues included how food was <br />prepared, the kitchen facilities, and seating. Both uses function as a convenience type for <br />take out or eat in services. Gaffron indicated that there was enough parking on the <br />applicant's specific site for the use. <br />Gaffron reviewed types of restaurants and the amount of seating and parking required. <br />Based on the information. Staff reviewed whether it was practical to regulate products <br />and uses within the zoning district. He felt the City's goal should be to regulate the <br />impact and not the product. Based on the information, Gaffron added to the amendment <br />a condition "d" stating that an individual use would be limited to 45 seats, or 60 seat <br />maximum for a combined use. <br />Dillon said they have worked well with staff and feel the conditions are satisfactory. <br />There were no public comments. <br />Flint moved, Goetten seconded, to adopt Ordinance No. 170, 2nd Series.\ ote.
