t <br />MINUTES OF THE ORONO PLANNING COMMISSION <br />MEETING HELD ON JANUARY 20, 1998 <br />(#17 - #2333 Home Occupations - Continued) <br />Curtis Krantz, 2120 Fox Street, voiced his approval of Staffs preference regarding <br />eliminating licensing, strengthening the zoning regulations, and handling violations on a <br />complaint basis. He was informed that farming is an agricultural use, not regulated as a <br />home occupation. Krantz supported the draft but questioned the ability of City employees <br />to enter homes and limiting the number of customers. He feels the City is overstepping <br />their bounds by limiting the number of customers, which he feels is a restraint of trade. He <br />asked how it would be policed. Lindquist informed him that the City would respond to <br />complaints. Smith said the boundaries are set to use only when a complaint is received. <br />Krantz was informed that the regulations apply to residences and a more intense business <br />use should be located in a commercial area in order to maintain the character of residential <br />neighborhoods. Schroeder noted the increase in traffic would not benefit a neighborhood. <br />Lindquist said the City is attempting to place reasonable limitations on home occupation <br />and to give people an idea on what is acceptable. He informed Krantz that the <br />Commission is happy to hear any suggestions for changes and incorporate rules that <br />benefit the community as a whole. <br />Smith noted that the provisions are for response to complaints on what is reasonable and <br />not necessarily a mandate. Krantz agreed with handling problems on a complaint basis. <br />He does not feel the City has the right to limit the business. <br />Krantz asked if firearm dealers would be able to continue operation in the City. Lindquist <br />asked Krantz to submit his name for notification of any public hearings regarding the <br />issue. Lindquist said the matter will be discussed in the near future. <br />Schroeder moved, Hawn seconded, to table Application #2333. Vote; Ayes 5, Nays 0. <br />(#18) #2327 ORONO DEVELOPMENT, LLC, 2380 SHADY\VOOD ROAD - An <br />amendment to Section 10.44 of the Zoning Code to allow coffee shops, bagel and <br />pizza restaurants in the B-5, Limited Neighborhood Business District - 11:38 p.m.- <br />12:03 a.ni. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />The Applicants were present. <br />Gaftron reported that the request for an amendment to the B-5 Limited Neighborhood <br />Business District to allow as a conditional use, three specific additional uses; 1) coftee <br />retail sales, 2) bagel retail sales, and 3) pizza retail sales. This request is in conjunction <br />with an application for development of the church property by Orono Development. <br />Gaftron agreed with Mr. Krantz of the need to update the list. <br />.0
