The variance request appears to be consistent with existing <br />conditions of the surrounding properties. <br />3) The City of Orono requires a twenty foot setback for parking areas in a front yard. The <br />front yard of the proposed development is along Shadywood Road and is proposed to have a five <br />foot setback. The five foot setback would include a sidewalk for pedestrian traffic along <br />Shadywood Road in front of the development. The front yard setback on this proposed <br />development is physically limited because of the existing ponding area on the east side (rear) of <br />the site. The location of this pond and the required depths of the proposed building, including <br />drive and parking areas severely restrict the ability to provide a twenty foot setback as required <br />by the City ordinance. Due to the location of the existing ponding area, a front yard setback of <br />twenty feet would impact the ability of the proposed development to manage the storm water <br />from this site in a potentially decreased ponding area. <br />• <br />i n summary, our review of the proposed variance requests should result in a very <br />favorable development for the 2380 Shadywood Road location. The requests for allowed uses <br />under conditional use permit, the hardcover requirement variance and front yard setback variance <br />do not appear to be inconsistent with neighboring and existing properties within the B-S districts. <br />The proposed variances are an attempt to comply with the existing conditions, ordinances and <br />meet the intent of the City's Comprehensive Plan. The proposed plans are a reflection of the <br />special site conditions which are an effort to strike a balance between proposed land use plans, <br />the law and the City's Comprehensive Plan. <br />file:omodesc2 <br />- • • 9
