Vote; Ayes 5, <br />Nays 0. <br />(#9) #2319 RON LAUER, 1040 TONKAWA ROAD - VARIANCES - <br />RESOLUTION NO. 4024 <br />Ron Lauer was present along with architect, Bruce Schmidt, and prospective <br />homeowners, Mr. & Mrs. Bu-xton. <br />Gaffron reported that the property is located in the LR-IB, one acre Zoning District. <br />The 120' wide property meets 80% of the width standard for an existing lot. There is an <br />existing house on the property with a total of 39.5% hardcover in the 75-250' setback, <br />excluding plastic removed from landscaping, approved within the last ten years. The <br />original proposal was for new construction with hardcover of 35%. The majority of the <br />driveway and house is located in the 75-250' setback. The average lakeshore setback is <br />met by the plan. The house will be located 120' from the lakeshore. The Planning <br />Commission recommended approval on a vote of 3 to 2 subject to 75-250' zone <br />hardcover not to exceed 30%. <br />The applicant has revised his plan with more of the driveway located in the 250-500' <br />setback and reduction in sidewalk and patio to result in 75-250' hardcover at 29.78%. <br />The packet includes information regarding the new plan and hardcover calculations. <br />Gaifron indicated that the minority vote in the Planning Commission recommendation <br />stipulated that there was no hardship shown for hardcover to exceed the 25% maximum. <br />Gaffron said Staff acknowledges the difficulty in meeting the 25% hardcover limitation <br />on smaller lots. This lot is larger, however, and Staff finds it difficult to justify exceeding <br />the limitation. The applicant is asking for approval of a 30% limitation and did receive <br />some support for this request by the Planning Commission.
