Mabusth, Building & Zoning Administrator <br />Date:March 14, 1991 <br />Subject: #1457 Alan Carlson, 3140 Watertown Road <br />A. Revised Preliminary Plat - Public Hearing <br />B. Conditional Use Permit/Variance - Public Hearing <br />Pertinent Ordinance- <br />Section 11.10, Subd. 16 (D) - Applicant Proposes a substantial <br />change from the preliminary subdivision approved by Council on <br />March 12, 1990. Applicant has made appropriate payments and <br />staff has scheduled a second public hearing to review the revised <br />plan. <br />Section 11.03, Definition 24 - Lot area, minimum. Each rural lot <br />must contain a minimum of 2 acres exclusive of --------------, <br />vehicular or pedestrian easements. Applicant proposes a 15' wide <br />driveway easement through the southern portion of Lot 1, Block 2. <br />Driveway easement at 15* = 3,000 s.f. in area (15' x 200'). <br />Required 87,120 s.f. <br />Proposed » 84,130 s.f. or 1.93 buildable acres. <br />In the second phase of this review, the conditional use <br />permit/variance application, applicant proposes bike trails <br />through sections of residential lots. Applicant must be advised <br />that these bike trails must be excluded from the dry buildable <br />area of the residential lots. This again will place restrictions <br />on Lot 1, Block 2. Lot 2, Block 2 has adequate area and as <br />Gaffron's memo notes. Exhibit D, the bike trail along the <br />southern side of Lots 1 and 2 may create problems for a <br />drainfield site. <br />Section 11.03, Definition 26 - Lot, out lot. Use of these out lots <br />must be approved by Council and such use restricted by <br />appropriate restrictive covenants or open space easements. The <br />following outlots and uses are proposed: <br />Outlot A - Private road outlot. <br />Outlot B - Pedestrian trail to commons area. <br />Staff would ask why this could not be combined as one <br />outlot since they are contiguous (B C). <br />Outlot C - Commons area. <br />Outlot D - Unbuildable and desginated for future development. <br />Outlot E - Road outlot to future developed property at north. <br />Outlot F - Remainder of property at north side of Burlington <br />Railroad available for combination with adjacent <br />properties if applicant wishes to sell.
