- J A=^' <br />r>F.C’.Af>-ATI'Vr f>f-' .'•*OVFNA*;VS <br />•niis Heclacatioa of Cov.-n.ini s i*? -ni !»? -ir. 1 <?ntpre.1 into <br />this 13th 'lay of July l?R7 by and between Craiqbamt <br />Associates, a Minnesota General I'artnerahip (‘’Ctaiqbank”) and the <br />City of Orono, a Minnesota menirripacorporation ("City"). <br />WHEREAS, CraiqbanV ie the owner of a certain tract of land <br />located in the City of Orono, County of Hennepin, State of <br />Minnesota, legally described in the attac.ied Fxhibit A <br />("Property"), which is made a part of this document; and <br />WHEREAS, Craigbank has na !e application to the City for -i <br />variance and conditional use permit to build un enclosed sports <br />recreational accessory buildinq ("Sports Center"); and <br />WHEREAS, the City Council granted the application on June <br />22, 19H7 subject to Craigbank nootim certain conditions set forth <br />in Resolution Mo. 2204. <br />Mow, THEREFORE, in consileracion of the approval granted to <br />Craigbank as set forth in Hcsolution 'lo. !)204, Craigbank does <br />covenant with the City as followest <br />1. <br />2. <br />3. <br />4. <br />5. <br />That the Sports Center shall never be used for <br />commercial purposes but shall be used solely by the <br />property owners for their private use and for the use <br />of the property owners, their families and non-paying <br />guests. <br />That if the Prooerty is ever subdivide 1, the <br />principal residential structure currently existing on <br />the property and "Sports Center shall remain on a <br />parcel of pronerty that maintains at least 13.5 acres <br />in area and maintainn at least a ISO foot setback <br />between the Snorts Center and all newly created <br />property lines. <br />That the Sports Center shall never be sold separately <br />from the main residential structure currently <br />existing on the Property. <br />That access tc the Sports Center shall be solely from <br />the private driveway on the Property as set forth in <br />Exhibit B-l of Resolution Mo. y?.04. <br />That the Sports Center structure shall be adequately <br />screened as describe*! in Exhibits B-l through h-4, <br />inclusive, of Resolution Mo. 2204 from the public <br />roadway and from the neighboring residences so as not <br />to appear as a commercial structure. <br />«
