r.' <br />4. <br />5, <br />a)The location of the house on the property to the west <br />and the presence of dense, natural screening within the <br />side yard of applicant's property will minimize the <br />impact of the intensification of the accessory <br />structures as proposed. <br />The proposed structure will have no greater impact than <br />the existing accessory structures placed less than 10* <br />apart. <br />The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to <br />other property in this zonina district; that granting the <br />variance would not adversely *\ffect traffic conditions, <br />light, air nor pose a fire azard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to *"he applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to pre <br />serve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the <br />effect of the proposed variance on the health, safety and <br />welfare of the community. <br />COHCLOSIONS, OR]AMD COHDITIOHS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby grants variances to Municipal Zoning Code Sections <br />10.03, Subdivision 9 (C)3(a) and Subdivision 9 (D) to permit the <br />permanent connection of the two accessory structures as described <br />above, subject to the following conditions; <br />1.The connecting of the two accessory structures shall be <br />subject to all relevant standards of the Uniform Building <br />Code. <br />2.The subject structure can never be used for the housing or <br />keeping of animals. <br />Page 2 of 4
