.� 0,�. <br /> O � O � CITY of ORONO <br /> � <br /> � �� � RESOLUTION OF THE CITY COUNCIL <br /> �'� �J C,'�' NO. <br /> L�kEsH�g'� <br /> WHEREAS, after due published notice and mailed notice in accordance <br /> with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held <br /> by the Orono Planning Commission on August 19, 2013 at which times all persons <br /> desiring to be heard concerning this application were given the opportunity to speak <br /> thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 13-3624. <br /> 2. The Property is located in the LR-1 B, One Family Lakeshore Zoning <br /> District which requires a minimum lot area of 1.0 dry acres and a <br /> minimum lot width of 140 feet. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on August 19, 2013 and voted 6 for and D against on a motion to <br /> approve the CUP. The Planning Commission finds that the following <br /> factors support the granting of the requested CUP: <br /> a. The Property is 1.5 acres in area; has 173 feet of width at the <br /> lakeshore and 149 feet in width at the 75-foot setback. <br /> b. The request for fill in excess of 500 cubic yards will not impact the <br /> Property as viewed from the lake. <br /> c. The elevation which the fill is ultimately achieving will be consistent <br /> with the grades on the Owner's property to the south. <br /> d. The fill will be brought in over the Owner's access off of Bohns Point <br /> Road and not over the shared driveway accessing off of North Shore <br /> Drive. Neither the shared driveway nor the adjacent properties will be <br /> negatively impacted by the proposed fill. <br /> 4. The City Council has considered this application including the findings <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the <br /> proposed CUP on the health, safety and welfare of the community. <br /> Page 2 of 4 <br />
