) <br />Zoning Ordir.ance <br />Section 3C0.04. <br />Pace 23 <br />SUBDIVISION 6.APPEAL^. <br />a)Any person <br />commission <br />agorio'^ed oy a decision of the planning <br />tegarc’ing an application on which the <br />decision of the planning commission may be final may <br />appeal such decision to the city council. The appeal <br />shall be submitted in writing within 10 days of the <br />date of the decision or the decisions stands. Jpon <br />appealr the city council shall consider the request <br />within 90 days urless ar extended period is agreed with <br />the appellant. The -ty council may reverse the <br />decision of the plarnin^ ..Mtunission by an affirmative <br />vote of two-thirds cf -t.^ ull membership. (Amended by <br />Ordinance 87-450, 1-20-b".) <br />Any person aggrieved by a decision of the director of <br />planning regarding an application the director of <br />planning is authorized by this ordinance to grant or <br />deny may appeal such decision to the planning <br />commission. The appeal shall be submitted in writing <br />within 10 days of the date of the decision. Any person <br />aggrieved by a decision of the planning commission <br />regarding an application first decided by the director <br />of planning may appeal the decision of the planning <br />commission to the city council. The appeal shall be <br />submitted in writing within 10 days of the decisxon. <br />The city council may reverse the decision of the <br />planning 'ommisslon by an affirmative vote of <br />two-thirds or its full membership. <br />In any matter in which the planni.ig commission's <br />decision is not final but is a recommendation to the <br />city council, the city council may adopt, modify or <br />reject the recommendation of the planning commission by <br />vote of a simple majority of those present, unless <br />otherwise required by this ordinance. <br />Any applii'int who obtains a building permit, starts <br />constructand/or begins a use in reliance upon the <br />decision of the planning commission, prior to the <br />termination of the appeal period, assumes the risk that <br />the decision may be reversed upon appeal. When an <br />appeal is received by the city the applicant will be <br />notified of the appeal and informed as to the date of <br />the city cruncil meeting where it will be heard.
