4 <br />MINUTES or MARCH 19, 1990 PLANNING COMMISSION MEETING <br />GABRIEL JABBOUR CONTINUED <br />Chairman Kelley allowed Mr. Jabbour the opportunity to <br />speak, but asked him to hold his corjnents within a 5-minute time <br />period. <br />Mr. Jabbour said, "As you probably know, I appeared two <br />weeks ago before the City Council e.xpressing concern and critcism <br />about the Planning Commission. I am concerned about the way in <br />which Orono has been treating the lakeshore and Lake Minnetonka, <br />jjj 2^975 Orono adopted our present Ordinance and it was an <br />exceptionally good first attempt to address all of the unique <br />concerns Orono has to address. Orono always set the pace for <br />other municipalities to follow. Lately, I find there is a sense <br />of confusion regarding what our Ordinance intended to do and the <br />way in which it is being interpreted. <br />I am concerned about the way in which non-conforming <br />structures within 0-75’ of t.he lake are being addressed. We <br />dealt with those in the past with a non-conforming use ordinance. <br />1 have been advised by City Staff that you can no longer deal <br />with non-conforming structures in that way because they are not a <br />use, they are a structure. In 1975 our Code said specifically <br />that any structure which did not have an appraised market value <br />$3,500 would be torn down. The City d^d not take it upon <br />themselves to go door—to—door to assure that those structures <br />were torn down, but felt that as time went by they would address <br />this issue. I had one of those structures on my property and I <br />hook out a permit from City Hall and tore it down. <br />Lately we have a lot of residents coming to the City to ask, <br />for additions to their primary structures within 75' of the lake. <br />The City has allowed the trading of hardcover to allow these <br />additions to be constructed. The hardcover addition may be a <br />wash out compared to the removals, but the intent of the <br />Ordinance was that the non-conforming structures would be <br />eliminated. I feel it is the duty of the Planning Commission to <br />amend the ordinance if a loop-hole is found to exist. I wish <br />that the Planning Commission would c.hange its position from being <br />f^^ehive to proactive. Orono was always ten steps ahead. I feel <br />the Planning Commission is sending a message to residents: If <br />you want to build within 0-75' of the lake, go now and put in a <br />rock garden with plastic underlining. Then come back to t.he City <br />and trade your plastic underlining in for a new living room.
