• • • <br />1 <br />CITY <br />ORONO <br />City of OROIVO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. _________________ <br />Drive to be used for boat sales and service. The Planning <br />Commission further directed the City Council to seek further <br />advise from the City Attorney regarding the legality of this <br />approval under Orono Municipal Code Section 10.03, <br />Subdivision 5 (E), since commercial use on the property had <br />ceased over 12 months ago and the current application for a <br />conditional use permit involved a change in use from the <br />conditional use permit approved in 1987 (File #1112). <br />24. On April 9, 1990 the City Council considered the <br />applicant's request (File #1497) for a conditional use <br />permit. The Council conceptually denied the conditional use <br />permit application that would allow a continued commercial <br />use of the residential property and directed staff to draft <br />the appropriate denial resolution for formal action by the <br />Council. In addition, the applicant was asked to provide a <br />plan for the restoration of an approved residential use on <br />the property and asked the applicant to meet with staff <br />within the next 30 days to discuss a plan for restoration. <br />25. At the request of the applicant and applicant's <br />attorney, Jim Gilbert, the Council once again reviewed the <br />conditional use permit application at their August 27, 1990 <br />meeting. The Council reaffirmed it's original action to <br />deny the conditional use permit. The applicant's attorney <br />sought direction on the specific issue raised in Finding #17 <br />and #19 noted above. <br />26. In a notice of Council action dated August 30, 1990, <br />the applicant was once again asked to meet with the Orono <br />staff to develop a plan for a residential use of the <br />property. As of this date the staff has not been contacted <br />by the applicant. <br />27. The City has been advised that the property continues <br />to be offered for commercial sale and use.
