They ask for approval of the original site plan <br />submitted with the sailboat operation in the 1987 review (review <br />Exhibit C). <br />Mr. Toberman is in the process of attempting to sell this <br />property. It is impossible for him to sell the property without <br />knowing what the City will allow now that the original <br />conditional use permit has expired. Mr. Toberman has been <br />advised that the City Attorney's office is preparing a memorandum <br />concerning the legal options of the City concerning the future <br />use of this property. The City has made it quite clear to Mr. <br />Toberman that they are concerned with the physical limitations <br />with this site for commercial use. The fact that a commercial <br />use has not been installed on this property within the legal <br />period of time suggests the unsuitability of this site for <br />commercial use. <br />As staff noted before, many of the required improvements set <br />forth in the original conditional use permit in 1987, such as <br />drainage improvements, fencing, landscaping, cosmetic repair of <br />exterior of building, internal modifications per floor plan <br />(Exhibit D) have been completed. In fact, some need upgrading <br />because the property has been vacant and not regularly <br />maintained.
