Box 66 <br />Crystal Bay, Mn.55323 <br />Re: City Planning Commission's aoDroval of After-the- <br />fact portion of application tor deck at 2,3C Shadywood <br />Rd. and their disapproval of the proposed portion <br />of the variance for a <4'x48’ second story catwalk which <br />would provide safe exit from the master bedroom and <br />living Quarters in the rear half of the home by linKinc <br />Co the lakeside deck. <br />Dear City Council: <br />FirsC, I would like to address the penalty involved with <br />Che approval of the after-the-fact portion of the variance <br />for ray deck. Please refer to my letter of November 19. <br />1990 Co Ms. Jeanne Mabusth explaining the circumstances <br />that led up Co my needing to apply for an ifter-the- <br />fact variance. Also, please review the letter and <br />addendum I submitted to the Planning Commisi'ion on Nov. 20,1990. <br />While Caking Chat information into consideration. I would <br />Chen reauesC that you waive the penalty of S175.00 for <br />Che variance and for the after-the-fact permit I will need <br />to procure. I will assume responsibility for the cost <br />of Che regular variance and building permit,since the <br />contractor who began the job has since gone bankrupt,and <br />I cannot prove he assured me he had taken out the necessary <br />permits. <br />Regarding Planning Commission's disapproval of Che catwalk <br />which would connect to Che deck. I would like Co ask you <br />to review this before I come before you on March 12,1991. <br />I am willing to remove Che plastic under Che landscape <br />area stated in Jeanne Mabusth’s letter of Feb.13,1991. <br />This would be a CaCal of 268 s.f. I also discussed with <br />Ms. Mabusth that I would also remove Che 24s.f. of plastic <br />under landscaping by rear stairs to bring Che total to <br />292 s.f. of removal of hardcover. The proposed catwalk <br />eouals 195.2 s.f. This catwalk is important to me from <br />a safety point only, as it provides Che only access from <br />my master bedroom in case of a fire. Ac the planning <br />meeting, one of Che members suggested that I could exit <br />through my window. This is totally absurd, given the <br />fact Chat my bedroom windows only measure 21" in width, <br />and there is an 8 foot drop to Che ground. Even if I <br />would be able to squeeze my 5’10" frame out Che window, <br />it is more Chan likely I would break my leg or back upon <br />reaching the ground. Furthermore, I would be very concerned <br />if my 80 year old mother, or relatives were Co be forced <br />to do the same. I truly believe that this catwalk should <br />be approved from not only an undue hardship point, but <br />also by removal of existing hardcover.
