Date: May 28, 2024 Item: 14 <br />Presenter: Laura Oakden, Community Development Director <br />Section: Consent Agenda <br /> <br />Title: #LA24-000024, 2980 Goldenrod Way, Variance - Resolution 7482 <br /> <br /> <br />1.Purpose: <br />This application is regarding lot area variance for the construction of a new house. <br />2.MN§15.99 Application Deadline: <br />This application was received on April 87, 2024 and deemed complete on April 18, 2024. <br />Therefore, the 60-day review period ends on June 17, 2024. <br />3.Background: <br />The applicant is requesting a lot area variance to develop the 1.7 acre property at the end of the of <br />Goldenrod Way addressed as 2890 Goldenrod Way. The property was platted in the 1980s as a <br />conforming 2 acre lot. When MnDOT conducted the Highway 12 project the parcel was taken <br />over by MnDOT as right-of-way to use for staging and support for the construction of the <br />highway. In 2022, MnDOT listed a portion of the property for sale but kept a portion of the land <br />as right way. As a result, the remaining land is substandard in size (1.7 acres) within the RR-1B, 2 <br />acre zoning district right-of-way. The new property owners are moving forward with a new home <br />project on the site and a lot area variance is needed because it is a substandard lot for the zoning <br />district. This application was reviewed by the Planning Commission on May 20th . <br />4.Planning Commission Vote and Comment: <br />The Planning Commission held a Public Hearing on May 20, 2024. The Commission discussed the <br />application and determined the substandard lot size was outside the control of the applicant due to <br />the MnDOT right of way requirements.
