Date: May 28, 2024 Item: 11 <br />Presenter: Natalie Nye, Planner <br />Section: Consent Agenda <br /> <br />Title: #LA24-000016, 3339 Crystal Bay Rd, Variances - Resolution 7479 <br /> <br /> <br />1.Purpose: <br />The applicant is requesting variances from average lakeshore setback, 75-foot lake setback, <br />hardcover within the 75-foot setback, overall hardcover, rear yard setback, and driveway width in <br />order to construct an addition to an existing home. <br />2.MN§15.99 Application Deadline: <br />The application was received on March 14, 2024 and deemed complete on March 25, 2024. The <br />120-Day timeline for review will expire on July 23, 2024. <br />3.Background: <br />The subject property is substandard in size and width and the current home on the property is <br />nonconforming. The rear setback, 75-foot setback and the average lakeshore setback bisect the <br />current home. Also, the hardcover on the property exceeds the maximum allowed at 37.7% where <br />25% is permitted. The applicant is proposing to construct an addition to the existing home. The <br />addition will include an additional garage stall on the first floor and a screened in porch on the <br />second floor. The proposal will also include an expansion of the driveway to accommodate the <br />third stall and the removal of a gravel parking area. The proposed addition increases the overall <br />hardcover on the site and increases the amount of hardcover within the 75-foot lake setback. The <br />addition will be built within the 75-foot setback and in front of the average lakeshore setback <br />line. <br /> <br />The applicant has revised the plans since the Planning Commission meeting and has removed the <br />front porch addition and reducing the size of the garage addition. Therefore reducing the proposed <br />hardcover of the project. The proposal had an overall hardcover of 44.39% and the revised plan <br />has reduced the overall hardcover to 42.12%. <br /> <br />The City Council reviewed the revised plans at the May 13th City Council Meeting and <br />found that the revised plans were reasonable and the property's substandard size and <br />existing conditions were practical difficulties. The City Council directed staff to draft an <br />approval resolution with a vote of 3 to 1. <br />4.Planning Commission Vote and Comment: <br />The Planning Commission held a Public Hearing on April 15, 2024. The Planning Commission <br />discussed the application and ultimately recommended denial of the application with a vote of 6 to <br />1. The Planning Commission noted that the overall hardcover was increasing and there was not <br />enough practical difficulties to support the addition of a third garage bay and front porch. The <br />Planning Commission recommended reducing the size of the addition, removing additional <br />hardcover or finding another solution to bring the property closer into conformance. <br /> <br />The applicant has since modified the plans by reducing the size of the addition, removing the front <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br /> <br />35
